General Provisions

The purpose of this Policy is to provide you with information on the purposes for which and the personal data that GUSEV collects and processes, on the scope of data and data processing periods, on data protection, as well as to inform you of your rights and obligations.

GUSEV is entitled to make amendments or additions to this Policy by publishing the current version of the Policy on the GUSEV website under the section "Privacy Policy".

Definitions

Processor — other legal persons, institutions or organisations that process your personal data on our behalf.
Data Subject — you.
Personal Data — information that relates to you as an individual and by which you can be identified. Such data reveal facts about your identity, such as your date of birth/age or your contact information.
Controller — that is us — SIA Gusev, unified registration number: 40003924329; we determine the purposes (why) and means (how) of personal data processing, and we bear the obligations of the controller as set out in applicable laws. In the section CONTROLLER'S CONTACT INFORMATION below, you will find details on how to contact us.
Regulation — Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
Cookies — small text files that are sent to your computer or mobile device when you visit our website and which our website stores on your computer or mobile device when you access the site. The Cookie Policy is available on the Gusev website under the section "Cookie Policy".

WHAT CATEGORIES OF PERSONAL DATA WE PROCESS, FOR WHAT PURPOSES AND ON WHAT LEGAL BASIS

It is your responsibility to provide only accurate, valid and necessary data for the purposes set out in this text. If personal data are inaccurate, you must correct them without delay. If you are unable to complete any of the mandatory fields, you must contact GUSEV.

Prior to the conclusion of a contract with Gusev, we process the following personal data of yours for the following purposes:

After you conclude a contract with Gusev, we will process the following personal data of yours for the following purposes:

We hope this will not occur, but we cannot exclude situations where you may have claims against us or we may have claims against you; therefore, communication data are necessary for handling and managing claims

Our legitimate interests (e.g. bringing a claim before a court or defending against your claims) and compliance with legal obligations applicable to us; Article 6(1)(c) and (f) of the Regulation

Transaction data — transaction date and place, transaction amount, invoice, contract, etc.

 

We hope this will not occur, but we cannot exclude situations where you may have claims against us or we may have claims against you; therefore, transaction data are necessary for handling and managing claims; in addition, transaction data are necessary for maintaining accounting records.

FROM WHAT SOURCES DO WE OBTAIN PERSONAL DATA?

We obtain your personal data when you provide them to us:
  • By completing the contact form on our website under the Contacts section
  • By entering into contractual relations with us
  • By contacting us by post, e-mail, WhatsApp application, telephone or in person
  • By fulfilling payment obligations

DISCLOSURE OF PERSONAL DATA

GUSEV does not use or share the information you provide to us, except in the following cases:

  • Where the relevant third party requires the data to be transferred for the performance of a concluded contract or the exercise of a function delegated by law, for example, to a credit institution for settlement purposes or to an accounting service provider for the purposes of maintaining accounting records.
GUSEV uses the services of AS "SEB banka" for settlements. AS "SEB banka" processes the received personal data as an independent controller in accordance with the obligations binding on credit institutions under European Union and Latvian regulatory enactments. You may familiarise yourself with the personal data processing principles of AS "SEB banka" at https://www.seb.lv/privatuma-politika, and you may obtain further information on data processing carried out by AS "SEB banka" by writing to personasdati@seb.lv or by sending a letter by post to: Elizabetes iela 95, Rīga, LV-1050, Latvia.
  • To persons provided for by external regulatory enactments upon their substantiated request (e.g. law enforcement authorities, rescue services, the State Revenue Service, etc.);
  • For the protection of the legitimate interests of GUSEV in the manner prescribed by regulatory enactments, for example, by bringing proceedings before a court or other public authorities against a person who has infringed the legitimate interests of GUSEV, or for the purpose of debt recovery by transferring data to a debt recovery service provider.

WHERE DO WE PROCESS YOUR PERSONAL DATA?

We process your personal data within the territory of the European Union/European Economic Area.

When we use Google Analytics, your personal data may be transferred to or processed in a country outside the EU/EEA, as Google Analytics stores data on Google servers located in various countries worldwide. Please read more about this in the Cookie Policy.

HOW LONG ARE MY PERSONAL DATA STORED?

GUSEV stores and processes your personal data for as long as at least one of the following criteria is met:
  • the contract concluded with you remains in force;
  • for as long as GUSEV or you are able to exercise your respective legitimate interests;
  • for as long as either party is subject to a legal obligation to retain the data (for example, pursuant to the Accounting Law, issued invoices must be retained by us for at least 5 years, etc.);
  • for as long as your consent to the storage of data remains in effect (applicable only in cases where there is no other legal basis for retaining personal data, for example, in cases where data were obtained in the course of marketing activities).

Upon expiry of the data retention period, the data are securely deleted or anonymised so that they can no longer be associated with you.

Accounting source documents, such as contracts, invoices and payment information — for the fulfilment of accounting requirements in accordance with Article 28(5) of the Accounting Law — for the purpose of ensuring payment source documents — are retained for 5 years.

Where your personal data are required to protect our or your legitimate interests in the event of a civil dispute — for no longer than 10 years from the date on which the right of claim arises for you or for us.

If a claim and/or request is resolved by the signing of a settlement agreement, such settlement agreement containing your personal data is retained for 10 years.

HOW WE ENSURE DATA SECURITY

GUSEV protects your personal data using modern technologies, taking into account the existing risks to the privacy of natural persons, as well as the technical, organisational and financial resources reasonably available to GUSEV, including by applying the following personal data protection security measures:
  • Use of antivirus software
  • Data encryption (HTTPS SSL protocol)
  • Renewal of e-mail and computer passwords every 2 months
  • Employee training

YOUR RIGHTS

Data protection laws grant you a number of rights with regard to the processing of your personal data.

Right of access to personal data
You have the right to request confirmation from us as to whether we are processing personal data relating to you, and in such cases to request access to the personal data we process. To exercise the aforementioned rights, you may submit a written request to us.

Rectification of personal data
Furthermore, if you believe that the information held about you is inaccurate or incomplete, you have the right to request that we rectify it.

Withdrawal of consent
Where we process your personal data on the basis of your consent, you have the right to withdraw your consent to the processing of personal data at any time. You may change your preferences and withdraw your consent by submitting a written request to us.

Right to object to processing based on legitimate interests
You have the right to object to the processing of personal data based on our legitimate interests. However, we will continue to process your data even if you have objected, if we have compelling legitimate grounds to continue the processing. To exercise the aforementioned rights, please submit a written request to us.

Erasure
In certain circumstances, you have the right to request that we erase your personal data. However, this does not apply in cases where the law requires us to retain the data. You may request the erasure of specific data by submitting a written request to us.

Restriction of processing
In certain circumstances, you have the right to restrict the processing of your personal data. Please note that if you request restricted processing of your data, this may affect your ability to receive our services. To exercise the aforementioned rights, please submit a written request to us.

Data portability
Finally, you have the right to receive or transmit your personal data to another controller ("data portability"). This right applies only to data that you have provided to us based on your consent or a contract, and only where processing is carried out by automated means. To exercise the aforementioned rights, please submit a written request to us.

Please contact us by e-mail at: info@gusevs.lv if you wish to submit a request to exercise your rights (indicating the purpose for which the information is required, a detailed description of the situation, and the time period for which information is required will help us to respond to you more quickly).

We will consider your request without undue delay and will inform you of the fulfilment or non-fulfilment of the request no later than one month from the date of its receipt. In the event that fulfilment of the request requires more time, we are entitled to extend the period of fulfilment by a further two months, but in any case you will be informed thereof within one month.

We are entitled to decline to fulfil your request:
  • if it is not formulated clearly;
  • if we are unable to identify you;
  • if we have already provided a response to such a request;
  • if the volume of information requested is disproportionate;
  • if the request is unsubstantiated (does not relate to our company, no explanation is provided as to why the request should be fulfilled);
  • if regulatory enactments provide that we are not entitled to provide you with such information or that we are obliged to retain certain data concerning you.
